The plaintiff/respondent sued the defendant/appellant in the Lagos High Court for among other things the sum of N 1,349,671.54 being the outstanding principal and interest in respect of the loan granted to the appellant to purchase a car in the course of his employment; and the ordinary/personal loan granted to same.
Judgment was granted in favour of the plaintiff/respondent.
Dissatisfied, the appellant appealed to the Court of Appeal which allowed the appeal in part and found that except as to the lower court’s order striking out the counter-claim of the appellant, the appeal lacked merit and same was dismissed.
Aggrieved by the decision, the appellant came before the Apex Court.
